Your Photo Upload service
The Your Photo Upload service is a service provided by Kuvaverkko, allowing the Customer to upload their own digital photo files to Kuvaverkko’s system for the purpose of producing photo products. The Your Photo Upload service forms part of Kuvaverkko’s overall service offering and is subject to Kuvaverkko’s general Terms and Conditions as well as the special terms set out below. By uploading digital files to Kuvaverkko’s online store or by clicking the “order” button (or equivalent) in our ordering service, the Customer confirms that they accept Kuvaverkko’s general Terms and Conditions.
1. Customer’s responsibility for photo files
The Customer is responsible for ensuring that they have the right to use, reproduce and order products made from all photo files they upload. The Customer warrants that the use of the uploaded photos does not infringe any third party’s copyrights, privacy, personal data protection or other rights.
Kuvaverkko does not verify the copyrights or usage rights of the uploaded photo files and is not responsible for the content of photos provided by the Customer. Kuvaverkko shall not be liable for any damage related to uploading photos, such as material costs, data transfer fees, costs incurred in taking photographs, or the value of lost memories. The Customer is solely responsible for backing up their own digital material.
2. Photo content
The Customer undertakes and is responsible for ensuring that no material contrary to law, good practice or these terms is uploaded to the Your Photo Upload service. Kuvaverkko reserves the right to refuse to produce or deliver products if the content of the photo files is clearly offensive, inappropriate or unlawful. Any unlawful content detected will be reported to the authorities. The Customer must provide accurate and sufficient personal information. Use of the Your Photo Upload service anonymously or by providing false personal details is not permitted.
3. Photo quality and final result
The Customer is responsible for the technical quality of the uploaded photo files, including resolution, cropping and color reproduction. Kuvaverkko produces products based on the files provided by the Customer and is not responsible for the final result if the quality of the photo files is not suitable for the selected product. In some products, the photo ordering system automatically restricts cropping options if the resolution of the uploaded photo is clearly too low for the intended use. Insufficient photo quality does not prevent the online order from being completed.
The technical color settings used in photo production may affect the colors of the final product, and therefore the colors and exposure may differ from those displayed on the Customer’s screen. Production settings used for manufacturing photographs do not alter the Customer’s responsibility for the quality of the original photo file. After an order is placed, photos are transferred directly to production and are not edited or processed prior to manufacturing.
4. Right of withdrawal
Products ordered through the Your Photo Upload service are manufactured based on the Customer’s individually provided photo files. For this reason, orders do not have the standard right of withdrawal under consumer protection legislation once the order has entered production, unless the product has a manufacturing defect. The limitation of the right of withdrawal is in accordance with Section 16 of the Finnish Consumer Protection Act (30 December 2013/1211).
5. Storage of photos
Kuvaverkko stores the photo files uploaded by the Customer through the Your Photo Upload service for the duration necessary to process the order and handle any potential complaints, after which the files are deleted from the system in accordance with secure data protection practices. The Customer’s photo data is used solely for the proper processing of orders. The defined storage period for photos is two (2) months.
